Our Services
Triyarc provides premium digital solutions. The specific scope, deliverables, and timelines for your project will be detailed in a separate Statement of Work (SOW) or project contract.
Intellectual Property
All original content, features, and functionality provided by Triyarc are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Client-specific deliverables become the property of the client only upon full clearance of all related invoice payments, as outlined in the project agreement.
User Duties
You agree not to use our services for any unlawful purpose or to conduct any activity that would damage, disable, overburden, or impair our servers or networks. You must not attempt to gain unauthorized access to any of our systems.
Payments & Billing
Payment structures (milestones, retainers, or hourly rates) are strictly defined in your individual contract. Invoices are due upon receipt unless otherwise stated.
Late payments may incur additional fees or result in a temporary suspension of ongoing development services until the balance is resolved.
Confidentiality
We maintain strict confidentiality regarding all client projects, business strategies, algorithms, and proprietary data shared with us. A formal Non-Disclosure Agreement (NDA) can be executed upon request prior to project commencement.
Limitation of Liability
In no event shall Triyarc, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
This applies to damages resulting from your access to or use of our services, any conduct of any third party, or any unauthorized access to our secure servers.
Termination
We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
